1. Nature of the Service
Maher Tidal Intelligence ("the Service") is a decision-support tool that provides tidal height and timing predictions to assist ports, harbour authorities, and their personnel. The Service supplements, but does not replace, official tide tables, statutory navigation information, the judgement of the harbour master, the judgement of the pilot, or the user's own established safety procedures.
The Service does not control any vessel, issue navigational instructions, or make operational decisions of any kind. All decisions relating to vessel movements, loading, timing, or under-keel clearance remain solely and entirely the responsibility of the user and their organisation.
2. No Warranty of Fitness for a Specific Decision
Maher Tidal Intelligence takes reasonable care in producing its predictions and validates its methods against real, independently sourced tidal data. However, no warranty is given, express or implied, that any individual prediction will be accurate for the purposes of any specific operational decision.
3. User Responsibility
The user agrees to maintain and continue using their organisation's existing safety procedures, official tide tables, and independent sources of navigational information at all times.
4. Limitation of Liability
To the fullest extent permitted by the applicable governing law, Maher Tidal Intelligence's total liability is limited to fees paid in the twelve months preceding any claim, and excludes liability for indirect or consequential losses including demurrage, lost profit, cargo claims, vessel damage, or delay costs.
5. Service Availability
The Service is provided on a reasonable-endeavours basis and is not guaranteed to be uninterrupted.
6. Confidentiality and Intellectual Property
The prediction method underlying the Service is proprietary and confidential and remains the property of Maher Tidal Intelligence.
